Agreement

By creating an account or using https://heywakey.com, you agree to these Terms, the Privacy Policy, the Disclaimer, and the Cookie Notice. If you do not agree, do not use Wakey.

The service

Wakey produces a personal morning briefing (politics, automotive, world economics, and gaming), optional spoken audio, notes, and email delivery. Features marked as coming later (Gmail/Outlook skim, iPhone messages) are not part of the current contract until we enable them for your account.

We may change, pause, or discontinue features. Overnight generation depends on third-party news feeds, AI providers, and email delivery; a given morning may be late, incomplete, or skipped.

Eligibility and accounts

You must be at least 13 years old. You are responsible for activity on your account and for keeping sign-in methods secure. One person per account. Do not share credentials.

Acceptable use

You agree not to:

• Probe, scrape, or overload the service except through documented ingest APIs with your own credentials.
• Upload others’ private mail or messages without authority to do so.
• Use Wakey to violate law, harass anyone, or infringe IP.
• Misrepresent AI output as human-authored news reporting or as professional advice.
• Attempt to bypass authentication, quotas, or payment if we later add paid plans.

Your content

You keep ownership of notes and anything you post to ingest APIs. You grant us a limited license to host, process, and display that content solely to provide Wakey to you (including sending it to AI and email processors). You represent you have the right to provide that content.

Our content and sources

Briefing layouts, the Wakey name, and original copy we generate are ours or our licensors’. Story links point at third-party publishers; their terms and copyrights apply. We do not claim those articles as our own.

Email

If you save a morning-email address in Settings, you ask us to send the digest to that address. Clear the field to stop. That is the primary unsubscribe path. You can also email privacy@heywakey.com. Briefings are service messages you requested, not unrelated advertising.

Disclaimer of warranties

Wakey is provided “as is.” We do not warrant that briefings are accurate, complete, timely, or suitable for any decision. See the Disclaimer for news, markets, and AI limits. To the fullest extent allowed by law we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent allowed by law, Wakey and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from the service or a briefing. Our total liability for any claim relating to Wakey is limited to the greater of (a) amounts you paid us in the 12 months before the claim or (b) USD $50. Some places do not allow these limits; there they apply only as far as permitted.

Indemnity

You will defend and indemnify Wakey against claims arising from your content, your misuse of the service, or your violation of these Terms, except to the extent we caused the harm.

Termination

You may stop using Wakey and delete your account at any time. We may suspend or close accounts that violate these Terms or that create legal or security risk. Provisions that should survive (IP, disclaimers, liability limits) survive termination.

Governing law

These Terms are governed by the laws of the United States and the State of New York, excluding conflict-of-law rules, except where a mandatory consumer law in your country says otherwise. Courts located in New York, USA may hear disputes, again except where local consumer law requires another forum.

Changes

We may update these Terms. Continued use after the “Last updated” date means you accept the revised Terms, except where law requires additional notice or consent.
